NVN successfully defended the owners of a stable who were sued when a 13 year old infant plaintiff sustained serious head injuries, a coma and permanent brain damage in a horseback riding accident. In a unanimous decision from the Appellate Division, it was held that the defendants had proved with competent evidence that they had maintained the riding arena in good condition and the infant plaintiff assumed the risk inherent in a dangerous sporting activity such as horseback riding.
